These Terms of Service govern the use of the Nimuki website and the purchase of products from Nimuki Private Limited a business operating under the brand name Nimuki, with its registered address at Floor No. 1, Flat No.: BL-II, FL-1C, Prasad Exotica, 71/3, Canal Circular Road, Kankurgachi, Kolkata, West Bengal – 700054. By accessing the website or placing an order, the user agrees to be bound by these Terms, the Privacy Policy, Shipping Policy and Return, Refund and Exchange Policy posted on the website.
1. Eligibility to use the website
Users may browse the website freely, but purchases may be made only by persons who are legally capable of entering into a binding contract under applicable law. Where a purchase is made on behalf of a child, the contracting party is the parent, guardian or other adult purchaser.
2. Product information and availability
Nimuki aims to ensure that all product descriptions, images, size information, pricing and availability details are accurate and up to date.
Minor variations in colour or appearance may occur because of lighting, screen settings or photographic rendering. These variations will not by themselves be treated as defects unless the delivered item is materially different from the product description.
3. Pricing and charges
All prices displayed on the website will be shown in Indian Rupees and should clearly disclose taxes, delivery charges and any other compulsory or voluntary charges in accordance with applicable e-commerce disclosure rules. Nimuki reserves the right to update prices, offers or availability at any time prior to order confirmation.
4. Order acceptance and cancellation
Placing an order constitutes an offer to purchase. An order is confirmed only after acceptance by Nimuki. Nimuki reserves the right to refuse or cancel any order for reasons including product unavailability, pricing error, suspected fraud, payment failure, abuse of promotional offers, excessive return behaviour or regulatory concerns, in which event any amount received will be refunded within a reasonable period.
No cancellation charge will be imposed on a customer cancelling an order after confirmation unless similar charges are borne by Nimuki where Nimuki cancels the order unilaterally, as required under the Consumer Protection (E-Commerce) Rules, 2020.
5. Payments
Nimuki may offer prepaid and Cash on Delivery payment options. Users agree to provide current, complete and accurate billing and payment information. Payment processing may be handled by third-party payment service providers, and Nimuki does not store full card details where a payment partner processes the transaction.
6. Shipping and delivery
Estimated delivery timelines are indicative and may vary by destination, product availability, courier operations, weather events, strikes, force majeure or other factors beyond reasonable control. If Nimuki cannot deliver within the stated delivery schedule and the delay is not due to force majeure, the customer will retain any rights available under the Return, Refund and Exchange Policy and applicable law.
7. Promotions and discount codes
Promotions, coupon codes and first-order offers may be subject to separate terms, minimum order values, product exclusions, validity periods and single-use restrictions. Nimuki may cancel or recover benefits obtained through misuse, fraudulent activity or breach of promotional terms.
8. User conduct
Users agree not to misuse the website, interfere with its normal operation, submit false reviews, impersonate another person, attempt unauthorized access, or use the website for unlawful or fraudulent purposes. The Consumer Protection (E-Commerce) Rules, 2020 prohibit false representation and misrepresentation in the online commerce context.
9. Intellectual property
All content on the website, including trademarks, logos, photographs, designs, graphics, text and page layouts, is owned by or licensed to Nimuki and is protected by applicable intellectual property laws. No content may be copied, reproduced, distributed, adapted or commercially exploited without prior written permission, except as permitted by law.
10. Limitation of liability
To the maximum extent permitted by applicable law, Nimuki will not be liable for indirect, incidental or consequential loss arising from the use of the website or purchase of products. Nothing in these Terms excludes liability that cannot lawfully be excluded, including liability in relation to consumer rights, fraud or willful misconduct.
11. Governing law and jurisdiction
These Terms will be governed by the laws of India. Subject to applicable consumer law rights, courts at Kolkata, India will have jurisdiction over disputes arising from or relating to the website or these Terms.
